IN THE UNITED STATES DISTRICT COURT FOR THE WESTERN DISTRICT OF PENNSYLVANIA FLAGSHIP YACHTS, L.L.C., a California Limited Liability Company, Plaintiff, v. M/Y GANDALF, Official No. 1074182, AND ALL OF HER ENGINES, TACKLE, ACCESSORIES, EQUIPMENT, FURNISHINGS AND APPURTENANCES, in rem, and MARK STANFORD, in personam and CARLA STANFORD, in personam, Defendants. Civil Action No. 14-cv-635-MRH NOTICE OF VESSEL ARREST NOTICE IS HEREBY GIVEN pursuant to Rules C and E of the Supplemental Rules for Certain Admiralty and Maritime Claims of the Federal Rules of Civil Procedure and Local Admiralty Rule LAR( c )(2) of the United States District Court in and for the Western District of Pennsylvania that on the 24th day of June, 2014, the United States Marshal arrested, seized and took into its possession Defendant Vessel MIY Gandalf, Official No. 1074182, that certain 1997 Lien Haw Industrial Corporation recreational vessel of 47.7 feet in length and 15.4 feet in beam, and all of her engines, tackle, accessories, equipment. furnishings, and appurtenances, etc., for the causes set forth in the Verified Complaint, to wit foreclosure of a Preferred Ship Mortgage in Plaintiff's favor, and for a deficiency judgment in the event the auction proceeds derived from the public auction of the Defendant Vessel are insufficient to satisfy all of Plaintiffs claims. This action is now pending in United States District Court for the Western District of Pennsylvania. The amount demanded in the Verified Complaint is a sum of not less than Seven Hundred Thirty Eight Thousand Five Hundred Eig~1teeu Dollars and Thirty Six Cents ($738,518.36), plus additionally accruing interest, late charges and other contractually recoverable fees, charges and expenses, including amounts which have been or are required to be disbursed by Plaintiff, together with post-judgment interest at the maximum statutory rate, plus costs of suit (including attorneys' fees). This arrest was made pursuant to an Order and Warrant for Arrest issued by the Clerk of the Court on or about May 22, 2014. Attorneys for the Plaintiff in this action are: Philip E. Notice is further hereby provided that an answer to the Complaint must be filed and served within 30 days after publication; otherwise, default may be entered and condemnation ordered. Notice is further provided that applications for intervention under Rule 24 of the Federal Rules of Civil Procedure by persons claiming maritime liens or other interests in the Defendant Vessel shall be filed within the time fixed by the Court.
