Notice of Intent to Remediate (NIR) Submittal Under the Pennsylvania Land Recycling and Environmental Remediation Standards Act Pursuant to the Land Recycling and Environmental Remediation Standards Act, the act of May 19, 1995, P.L. 4, No. 1995-2. ("Act 2"), notice is hereby given that Three Crossings, L.P. ("Remediator") has submitted to the Pennsylvania Department of Environmental Protection a Notice of Intent to Remediate for properties located near the intersection of 26th and Smallman Streets, Pittsburgh, Pennsylvania. The subject properties are listed by parcel numbers: 25-J-138, 25-J-142, and 25-J-182. The subject properties ("Site") currently include a restaurant and parking lots. Historically, the Site was used for a variety of industial activities, including steel casting, a lumber yard and chemical manufacturing. Initial environmental assessment activities were completed in 2012 to begin characterization of the Site conditions. The Remediator has performed additional characterization of soil, groundwater and soil gas quality to further evaluate the Site conditions. The Remediator intends to pursue a release from liability under Act 2 using the Special Industrial Areas ("SIA") provision established under Section 305 of Act 2. A Work Plan for Baseline Remedial Investigation and a Baseline Environmental Report will be submitted to the Pennsylvania Department of Environmental Protection to obtain a release of liability for soils and groundwater under Act 2.
