NOTICE OF PUBLIC HEARING AND NOTICE OF PROPOSED REGULATION AND AMENDMENT OF REGULATIONS Allegheny County Board of Health The Allegheny County Health Department is seeking public comment on proposed amendments to Article XI of its regulations. These pertain to administrative hearings and appeals of alleged violations of health department regulations. The proposed amendments to Article XI "Hearings and Appeals" would: 1) Add definitions for "Hearing Officer," "Intervenor," and "Stay of Proceedings," terms which the Health Department frequently uses, but previously did not have codified definitions. 2) Extend the appeals period from 10 days to 30 days, in order to align Health Department rules with the rules of the Environmental Hearing Board, and give appellants more time to draft appeals. 3) Add a new section on Intervention (§ 1104.1), which formalizes a procedure for interested parties to intervene in complex, multi-party appeals. 4) Add a new section on Consolidation and Substitution of Parties (§ 1104.2) to allow related cases to be combined and allow for parties in a case to change. 5) Add a new section on Motions to Dismiss (§ 1108.1), which aligns the Health Department's legal standard on Motions to Dismiss with the Environmental Hearing Board and Pennsylvania Courts of Common Pleas. 6) Update the Health Department's Address from 3333 Forbes Avenue to 542 Fourth Avenue (§§ 1104(c) and 1105(E)). 7) Clarify that both the Director and Hearing Officer may establish procedural ground rules for hearings. 8) Amend burden of proof requirements to clarify when the Health Department has the burden of proof and when appellants have the burden of proof. DEPARTMENT OF HOMELAND SECURITY FEDERAL EMERGENCY MANAGEMENT AGENCY Proposed Flood Hazard Determinations for the Township of North Fayette, Allegheny County, Pennsylvania, Case No. 16-03-2516P. The Department of Homeland Security's Federal Emergency Management Agency (FEMA) solicits technical information or comments on proposed flood hazard determinations for the Flood Insurance Rate Map (FIRM), and where applicable, the Flood Insurance Study (FIS) report for your community. These flood hazard determinations may include the addition or modification of Base Flood Elevations, base flood depths, Special Flood Hazard Area boundaries or zone designations, or the regulatory floodway. The FIRM and, if applicable, the FIS report have been revised to reflect these flood hazard determinations through issuance of a Letter of Map Revision (LOMR), in accordance with Title 44, Part 65 of the Code of Federal Regulations. These determinations are the basis for the floodplain management measures that your community is required to adopt or show evidence of having in effect to qualify or remain qualified for participation in the National Flood Insurance Program.
