NOTICE OF PUBLIC COMMENT PERIOD INTENT TO VOLUNTARILY WITHDRAWAL FROM AUTHORITY OVER CHEMICAL ACCIDENT PREVENTION PROVISIONS The Allegheny County Board of Health will take public comment on its voluntary request for revocation of the authority to implement and enforce the Clean Air Act, Section 112 (r) chemical accident provisions as set forth at 40 C.F.R. Part 68 (the Risk Management Plan Rule). Under this request, the authority would be returned to the Environmental Protection Agency (EPA). Allegheny County Health Department has maintained jurisdiction to enforce 40 C.F.R. Part 68 since April 1, 2002, and is currently providing advance notice of its intent to voluntarily withdraw its delegated authority. After this withdrawal, which would occur on January 24, 2018, the EPA will be the authority responsible for the enforcement of this regulation. Copies of the voluntary request for revocation may be examined beginning Thursday November 9, 2017, at the Allegheny County Health Department Document Control Room, Building 7, Clack Health Center, from 8:30 AM until 3:30 PM Monday thru Friday; on the Allegheny County Health Department web site: http://www.achd.net/air/index.php ; or by calling 412-578-8120 to request a mailed printed copy.
