ON March 14, 2014, Free Flow Power Corporation (FFP), on behalf of FFP Missouri 5, LLC, FFP Missouri 6, LLC, and Solia 6 Hydroelectric, LLC, filed applications with the Federal Energy Regulatory Commission (FERC) for original licenses to construct and operate three proposed hydroelectric projects sites at the existing U.S. Army Corps of Engineers (USACE) owned dams located at: Emsworth L&D (P-13757), Emsworth Back Channel Dam (P-13761), and Montgomery L&D (P-13768) on the Ohio River in Pennsylvania. The license applications describe the proposed projects, their proposed operations, potential environmental effects, and protection, mitigation, and enhancement measures proposed to be implemented. The license applications include the results of studies conducted by FFP and a description of the consultation process undertaken by the applicant in the development of the project proposals. The 24 MW Emsworth L&D and 12 MW Emsworth Back Channel Dam projects would be located at existing USACE dam structures in Allegheny County, Pennsylvania. The 42 MW Montgomery L&D project would be located at the existing USACE dam structure in Beaver County, Pennsylvania. Each proposed project will be operated in run-of-river mode and will utilize the existing dam at each site. In accordance with 18 CFR § 4.32(b)(7), if any resource agency, Indian Tribe, or person believes that the applicant should conduct additional scientific studies to form an adequate factual basis for a complete analysis of the applications on their merits, they must file a request for the study with FERC not later than 60 days after the date on the application was filed and must serve a copy of that request on the applicant. Therefore, any such requests must be made by May 13, 2014. In addition, upon acceptance of the application for filing, FERC will publish subsequent notices soliciting public participation.
